Terms and Conditions of Use

JetSurvey S.L. provides users with a software and the necessary tools for making web-based or e-mail based surveys, as well as for the collection of data, analysis of results and other services which Jet Survey may offer in future. The services and use of the site www.jetsurvey.com are provided in accordance with the terms and conditions hereby established which users must read and accept when registering at JetSurvey.com.

Collection of information

Data collected in surveys is of the exclusive property of our customers and neither JetSurvey nor its employees will make use of this information in their own benefit, except with the express consent of the owner of the information. In addition, any other material provided to us by our customers (including graphics, e-mail addresses, etc.) will be preserved with the utmost confidentiality. JetSurvey will make every effort possible to guarantee that all information provided by our customers will be maintained in a secure environment.

Use of information

JetSurvey.com reserves the right to conduct statistical studies on user behaviour and characteristics in order to measure interest in and use of the various areas of our website.

JetSurvey.com collects IP addresses for the purposes of system administration and record keeping. An IP address is a number that is assigned to your computer automatically when you use the Internet. Our servers log incoming IP addresses. IP addresses are only analyzed in aggregate and no connection is made between you and your computer´s IP address. When tracking IP addresses we can determine which sites refer the most people to JetSurvey.com. Think of your IP address as your zip code which tells us in general terms where you come from.

Payment

User agrees to make payment in advance for the use of the services offered by JetSurvey.com by virtue of this agreement, including applicable taxes. Payment can be made by bank transfer o by means of the different internet payment processing systems that JetSurvey.com may use. At present PayPal is the payment system considered most secure by JetSurvey.com who has chosen it for its customers. Credit card information disclosed by JetSurvey.com customers is administered exclusively by PayPal and no JetSurvey.com employee can access this information. In the event the user´s credit card could not be processed for any reason, JetSurvey.com reserves the right to cancel the Service.

User account, password and security

Once the registration process is completed, User will logon with a password and account ID. User will be responsible for keeping the secret of this password and account and shall be fully responsible for all activities carried out under this password or in his/her account. User agrees (a) to notify JetSurvey.com immediately on any non-authorized use of his or her password and account, or of any other security violation and (b) to ensure that he/she logs off from his/her account at the end of each session. JetSurvey.com will not be held liable for any loss or damage resulting from non-compliance with this obligation by the user.

User Behaviour

User understands and agrees that all information, data, text, software, music files, sound files, photographs, graphics, videos, messages and any other material (herafter “the Contents”), transmitted public or privately, are the sole responsibility of the person from whom the Contents proceed. This means that the User, not JetSurvey.com, is fully responsible for the content of the surveys published, e-mailed, transmitted or otherwise released through the Service. In particular, the User, not JetSurvey.com, is responsible for the contents of surveys as well as for the audience to which surveys are addressed, therefore User must respect information rights and use of JetSurvey.com for Spam activites is strictly prohibited.

It is also strictly prohibited to send out surveys to minors via JetSurvey.com without the express consent of their parents or legal tutors. The User, and not JetSurvey.com, is responsible for compliance with this obligation.

JetSurvey.com cannot and does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. User understands that by using the Service, he or she may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will JetSurvey.com be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

User agrees not to attempt to damage, deny service to, attack the IT system´s integrity or security, transform, reverse engineer or otherwise interfere (hereafter “interfere”) with JetSurvey.com´s website. If User interferes in any way with JetSurvey.com´s website, he/she will be liable for all damages which such interference may cause, and shall be responsible for the costs that may derive from possible legal claims or actions. Interference with JetSurvey.com´s website by the User will exempt JetSurvey.com from any legal obligation with the User, including obligations acquired under JetSurvey.com´s Privacy Policy.

JetSurvey.com will cooperate with the legal authorities to control user behaviour which interferes with JetSurvey.com´s website, attempts to defraud JetSurvey.com or to defraud credit companies or others, through use of JetSurvey.com´s web site or services.

User agrees not to use the Service to:

1. Upload, publish, email, transmit or make available in any way any content that is unlawful, harmful, threatening, abusive, violent, defamatory, vulgar, obscene, invasive of another´s privacy rights, racist or ethically objectionable.
2. Engage in any conduct which may harm minors.
3. Impersonate any person, organization or entity, including, but not limited to, a JetSurvey.com employee, a group leader, guide or host, nor to misrepresent affiliation or relationship with any person, organization or entity.
4. Upload, publish, email, transmit or make available in any way any content to which the User has no right to access under law, contract or other legal theory (i.e. private, proprietary and confidential information, acquired or disclosed as a result of a labour relation or under a confidentiality agreement).
5. Upload, publish, email, transmit or make available in any way any content that may infringe any patent, trademark, trade secret, copyright or other property rights (hereafter “rights”) of any person, organization or entity.
6. Upload, publish, email, transmit or make available in any way any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, chain letters, pyramid schemes or any other form of unsolicited communication.
7. Interfere with, or disrupt, the Service or the servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the service.
8. Infringe any local, regional national or international law or legislation, deliberately or not.

Failure to comply with any provision of this section will exempt JetSurvey.com from any of its legal obligations with the User, including obligations acquired under JetSurvey.com´s Privacy Policy.

User accepts that JetSurvey.com may deny all or part of the Service for justified reasons, at any time, in its sole discretion. User agrees that JetSurvey.com may block User´s IP adress or addresses, at any time, in its sole discretion, thus denying the continous use of JetSurvey.com website by the User.

Propietary rights

Software Application Services are protected by copyright laws and international treaty provisions as well as other intellectual and industrial property laws and treaties. The Software Application Services are licensed, not sold.

All title and copyrights in and to the Software are owned by JetSurvey.com or its suppliers. All title and intellectual property rights in and to the Contents which may be accessed through use of the Software Application Services are the property of the respective content owners and may be protected by applicable copyright or other intellectual property laws and treaties.

Billing Policy

User agrees to provide JetSurvey.com with accurate and updated contact information during the registration process and as long as User account is active.

Account cancelation will result in the cancelation of all customer files.

Personal information

In compliance with applicable Personal Data Protection regulations we inform you that the personal data you provide shall be included and processed in JetSurvey S.L. files. Your data will be processed only for the purpose of sending you information, news or notices related to the JetSurvey tool. You may exercise the rights of access, rectification, cancellation and objection through info@jetsurvey.com.

In addition, and at the request of the User, JetSurvey.com shall remove all personal information from its databases relating to the User. However it may be impossible to remove all details and some residual personal information may remain on the site, because of backups and records of deletions.

JetSurvey.com, reserves the right to contact you regarding your account status or any other matter related to the service we provide and/or our records about you.

Warranties

JetSurvey.com shall not be liable for any loss or damage resulting from interruptions, delays, etc. in the Service.

JetSurvey.com cannot guarantee recovery of lost data, files or any other information, regardless of how or why the data or files have been lost. However JetSurvey.com offers its users the storage of data in different formats and out of JetSurvey.com´s servers.

User exempts JetSurvey.com from indeminity in the event of loss of data.

Survey analysis is made in order of arrival. JetSurvey.com is not responsible for the results obtained if the size of sample selected is not the most adequate or representative one. JetSurvey.com is not responsible for decisions or actions taken derived from the results of the surveys.

Severability

If any section, clause, or part of these Terms of Use is declared invalid by any court of competent jurisdicition, the remainder shall not be affected and shall remain in full force and effect.

The Terms constitute the entire agreement between the parties with respect to the matter hereof, and supercede any prior agreements, whether in writing or verbal. No waiver of any of the Terms of Use shall be binding unless executed in writing by JetSurvey.com.

Termination

JetSurvey.com reserves the right to terminate any legal relationship with a user/customer if it deems it to be harmful to its interests and objectives. In this event JetSurvey.com shall be exempt from any indemnity to the user or customer except for the reimbursement of the amounts paid in advance and not consumed.

JetSurvey.com reserves the right to block any account if it deems the amount of surveys and/or data received my collapse the service and affect the rest of customers.

User may cancel his/her account without cause at any time. Cancellation of an account will result in cancellation of all customer files.
